Dear Mr. Beasley:

The ringtone market in the United States is reaching one billion dollars in sales; can your organization come to the aid of United States consumers regarding ringtone purchases? The aid would consist of getting Congress to appoint an independent company to monitor ringtone sales in the wake of AT&T Mobility’s ringtone fraud settlement. AT&T Mobility used deceptive Internet advertisement to offer free ringtones, when consumers applied to get those ringtones AT&T unknowingly to consumers charged them for those ringtones.

It was by complaints to the state of Florida’s consumer protection that got their Attorney General Bill McCollum involved; because the fraud took place over the Internet there may be consumers in other states that are victims to the fraud. Would your orgaization also be able to inquire to Georgia Attorney General Thurbert Baker to see if Georgians may have unknowing been charged for ringtones through the Internet advertisement they believed where free ringtones?

Additionally, there is no independent monitoring of ringtones sales to protect artist, ringtone carriers are giving ringtone payouts based on an honor system, can this topic also be made part of your inquiry?

Furthermore, this request should also extend to Georgia customers of Verizon, Sprint/Nextel, Alltel and T-Mobile, carriers who are also being investigated regarding fraud to consumers.

It is good that someone has drawn attention to this matter of ringtones. AT@T should be held accountable for this matter severely, and yes some kind of industry standard should be place to track ringtone sales.
